By using our Services or opting into our SMS program, you agree to the practices described in this Privacy Policy. If you do not agree, please discontinue use of our Services. This policy should be read alongside our Terms of Service.

We collect information you provide directly to us and information collected automatically when you use our Services.
Information you provide directly:
- Identity information: First name, last name
- Contact information: Email address, mobile phone number
- Communication preferences: How you heard about us, opt-in consent records with timestamps
- Correspondence: Messages you send us via email or SMS replies
Information collected automatically:
- Usage data: Pages visited, time spent on site, referring URLs

SMS Messaging & Mobile Data
When you opt into our SMS messaging program at www.d6five.com/sms-consent/, we collect the following information specifically in connection with that program:
- Your mobile phone number
- Your opt-in consent record, including the date, time, and method of consent
- Your opt-out record, if and when you unsubscribe
- Message interaction data (delivery status, opt-out keywords)
Text messaging originator opt-in data and consent will not be shared with any third parties for marketing or promotional purposes. This includes but is not limited to the sale, rental, or transfer of mobile opt-in lists to any outside organization.
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing to subcontractors in support of our services — such as SMS platform providers (e.g., Twilio) acting as data processors — is permitted solely to operate the SMS program on our behalf and is governed by appropriate data processing agreements.
Our SMS program is operated in compliance with the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, CTIA guidelines, and carrier requirements under the A2P 10DLC framework. Message frequency varies; approximately 2–4 messages per month. Message and data rates may apply.

How We Use Your Information
We use the information we collect for the following purposes:
- To operate our SMS program: Sending text messages you have consented to receive, including updates, notifications, and value-added content
- To manage your subscription: Processing opt-in and opt-out requests, maintaining consent records

- Business transfers: In the event of a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction. We will notify you via email or prominent website notice before your data is transferred and becomes subject to a different privacy policy.
- With your consent: We may share your information with third parties when you have given us explicit permission to do so.

SMS Data & Third Parties
D6Five will not share, sell, rent, or disclose SMS opt-in data, mobile phone numbers collected for SMS purposes, or SMS consent records with any third party for marketing, promotional, or commercial purposes.
All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
The only third party with whom SMS-related data is shared is Twilio Inc., our SMS platform provider, acting strictly as a data processor to facilitate message delivery on our behalf. Twilio is bound by its own privacy policy and data processing agreements and does not use your data for its own marketing purposes.
SMS opt-in consent is specific to D6Five's messaging program. It is not transferable, not assignable, and cannot be used by any other party or campaign without your separate, explicit consent.

Data Retention
We retain your personal information for as long as necessary to fulfill the purposes described in this policy, comply with legal obligations, resolve disputes, and enforce our agreements.
- SMS consent records: Retained for a minimum of 4 years from the date of opt-in or opt-out, as required for regulatory compliance and carrier audit purposes
- Contact information: Retained while you are an active subscriber or have an active relationship with D6Five, and for up to 2 years thereafter
- Website usage data: Retained for up to 12 months
You may request deletion of your personal information at any time by contacting us at connect@d6five.com. We will honor deletion requests subject to our legal and regulatory retention obligations.

Security
We implement commercially reasonable technical and organizational measures to protect your personal information against unauthorized access, alteration, disclosure, or destruction.
